摘要
政府绩效管理在政府行政体制深化改革,推动政府职能转变,提升公共服务能力和回应公众关切方面发挥着重要作用。由于现阶段我国政府绩效管理法治化的缺失,绩效管理还未体现出其更大的价值。鉴于此,文章旨在明确政府绩效管理法治化原则,提出绩效管理立法的法律框架,建议通过完善领导、协调、救济机制,改善行政绩效环境,采取自下而上,渐进立法的方式实现我国政府绩效法治化建设。
Government performance management plays an important role in deepening the reform of the system,promoting the transformation of government functions,enhancing public service capacity and responding to public concerns.Due to the lack of rule of law in China's government performance management at this stage,performance management has not yet reflected its greater value.In view of this,the paper aims to clarify the principles of government performance management legalization,propose a legal framework for performance management legislation,and suggest a bottom-up and progressive legislative approach to realize the rule of law in government performance in China by improving the leadership,coordination and relief mechanisms and changing the administrative performance environment.
