宪法视阈下我国大学生网络言论自由的限制与保护研究初探

随着互联网的飞速发展,公民更加便利地借助互联网进行交流与沟通,畅所欲言的表达自己的观点,新时代的大学生也是使用网络交流思想的主体,如何理性的在网络阵地表述自己的观点成为新的课题。网络言论自由是宪法赋予公民的一项基本权利,同样也是符合人权保障的要求,但网络言论的“过度自由”容易侵犯其他公民的权利,甚至危害公共利益,因此自由是相对的,网络言论的自由也需要有一个限度。本文在立足宪法理论的基础上,从国家立法、部门监管、大学生自身等角度出发探索完善大学生网络言论自由的对策。

With the rapid development of the Internet,it is more convenient for citizens to communicate with the Internet and express their views freely.College students in the new era are also the main body of using the Internet to exchange ideas.How to rationally express their views in the network position has become a new topic.Freedom of speech on the Internet is a basic right granted to citizens by the Constitution,which is also in line with the requirements of human rights protection.However,the"excessive freedom"of speech on the Internet is easy to violate the rights of other citizens and even endanger the public interest.Therefore,freedom is relative,and the freedom of speech on the Internet also needs to have a limit.Based on constitutional theory,this paper explores countermeasures to improve college students’freedom of speech on the Internet from the perspectives of national legislation,departmental supervision and college students themselves.
