调解前置程序的困境与出路

The Dilemma of Mediation as a Prepositional Procedure and its Solutions

调解前置程序作为多元化解矛盾纠纷机制中的重要组成部分,在司法实践中主要面临两大层面困境,其一是以立案登记制与之形成的紧张关系和与其他司法程序衔接不畅等问题产生的外部压力,其二是因程序不完善产生了众多内生问题的内部困境。试图将调解前置程序从两大困境中解局,需要紧紧依据矛盾出现的根源进行考虑,既在缓和外部压力的方法上做思考,又注重对制度自身的完善,并且将眼光着眼于社会综合治理的大局,注意对社会整体资源的合理分配,长远于化解矛盾纠纷的整体效益。

Mediation as a prepositional procedure,one of the most important multiple dispute-resolving mechanism,is involved in two aspects of dilemmas in judicial practice:one is the external pressure caused by the tension between the registration system and other judicial procedures,and the other is the internal endogenous problems caused by imperfect procedures.To resolve the problem caused by putting mediation as a prepositional procedure,careful consideration is required based on the root causes of the contradiction,both in terms of ways to alleviate external pressure and to improve of the system itself.Furthermore,greater attention should be paid to the overall situation of social comprehensive governance,the rational allocation of social resources,and the long-term resolution of conflicts and disputes to obtain overall benefits.
