银行业涉租抵押物处置路径及风险防范

摘要 银行业不良资产处置过程中常遇到抵押物涉及租赁情况,易引发抵押物流拍、遭遇执行异议、被第三人占用、无法腾退等困难,使清收推进缓慢。本文梳理了涉租抵押物处置面临的困难,总结了银行采用的主流处置方法,分析了可以借助的法律维权手段,并从贷前尽职调查、完善合同监管账户、倡议登记互联信息等方面提出银行在处置涉租抵押物时需进行的风险防范建议。希望对银行处置人员清收涉及租赁不良资产抵押物工作有所帮助。 When cleaning up handing non-performing loan, the bank may often face collaterals involving lease.The failed auction of collaterals, the execution dissidence, the occupation of third party and the difficulties of vacation caused by collaters with loan, will temporize the liquidation schedule. This article, enumerating the liquidation difficulties, summarizing the mainstream liquidating methods, analysing the potential launching legal action, proposes risk prevention of liquidating collaters with loan, with, refining due diligence before release of loan, perfecting supervision account, proposing loan information registration. Expectantly, it is helpful for bank employees that using these methods to liquidate collaterals involving lease.
