FIDIC银皮书与我国新版工程总承包合同示范文本的索赔管理比较研究

Comparative Study of Claim Management between the General Conditions of China’s EPC Contract and FIDIC’s Silver Book

以承包商的视角,研究国际上普遍采用FIDIC银皮书合同条件以及我国新版工程总承包合同示范文本中的索赔条款,对比分析二者在索赔程序和主要索赔条款上的差异,分析承包商开展索赔应关注的要点。最后列举出FIDIC银皮书中承包商向业主索赔可引用的主要条款。

From the perspective of the contractor,this paper studies on the claim clauses in the internationally adopted FIDIC Silver Book contract conditions and EPC general contract demonstration text of China(2020 edition),compares and analyzes the differences in the claim procedure and the main claim clauses between the two contracts’conditions,the key points that the contractor should pay attention to in carrying out the claim.Then,it analyzes the main clauses that can be cited in the FIDIC Silver Book for contractors to claim EOT and(or)cost from the employer.
