摘要
竣工日期是建设工程施工合同中重要的概念,涉及工期计算、违约竣工、工程价款支付等重要问题。司法实践中关于计划竣工日期的争议主要表现为多个计划竣工日期、计划竣工日期的约定变更,法院裁判倾向于综合法条、证据推定当事人真实意思表示来确定计划竣工日期。司法实践中关于实际竣工日期的争议主要表现在司法解释的适用,多数裁判观点倾向于合同的约定应当优先于司法解释的适用。本文在明晰争议焦点及司法裁判倾向的基础上,提出对承包人的风险规避建议。
Time of completion is an essential factor in the performance of the contracts for construction project.It can affect the period of construction,breach,payment for the construction project and many others.Conflicts about planned time of completion in construction project cases appear to be conflictive planned time of completion,changes of planned time of completion.The judges will base on articles and evidences to decide what is the real intention between the offeror and offeree on planned time of completion.Conflicts about actual time of completion appear mostly likely to be different verdicts by the courts when applying the Interpretation of the Supreme People’s Court on issues concerning the application of law in the Trial of Cases Regarding Disputes over Construction Contracts for Construction Projects.And most judges prefer to refer to the contracts rather than articles.This paper aims to provide some risk warnings for the contractor based on sorting conflictive points verdicts in real cases.
