摘要
“以房抵款”作为常见的工程款清偿方式,因模式多样,缺乏明确裁判规则,实践中存在大量争议。以建设工程领域“以房抵款”的实务问题作为研究对象,收集多家施工企业2017年至今实际签订的26份以房抵款协议作为样本,通过分析协议文本内容与履行情况,结合司法判例,对“以房抵款”的常见模式、协议履行的影响因素、法律风险进行探讨,并对施工企业防范化解相应风险给出具体建议。
‘Debt Repayment by House’is a common way of project payment settlement,and there are a lot of disputes in practice due to the diversity of models and the lack of clear judgment rules.This paper takes the practical problems of‘Debt Repayment by House’in the field of construction engineering as the research object,and collects 26 agreements signed by many construction enterprises since 2017 as samples.By analyzing the content and performance of the agreement text,combined with judicial precedents,discusses the common mode of‘Debt Repayment by House’,the influencing factors of agreement performance and legal risks,and gives specific suggestions for construction enterprises to prevent and resolve the corresponding risks.
