Research on the Causes,Legal Relations and Countermeasures of Qualification Certificate Affiliation of Construction Industry

针对"证书挂靠"现状进行原因分析,对证书挂靠行为是否符合国家相关法律、法规以及规章制度的规定,挂靠人与被挂靠单位签订的合同的效力认定、劳动关系认定进行探讨,并就证书挂靠提出一些应对措施。

This paper analyzes the reasons for the certificate affiliation,and discusses whether the behavior of the certificate affiliation complied with relevant national laws,regulations and rules,and the validity and labor relationship recognition of the contract signed by the affiliated person and the affiliated unit.In addition,puts forward some countermeasures for the certificate anchored.
