Jurisprudence and Politics:A Probe into the Theory of the Sense of Community for the Chinese Nation

中华民族共同体意识是以习近平同志为核心的党中央基于对历史正反经验的总结以及对当前国内外形势研判后提出的重大命题。作为新时代的国家统一之基、民族团结之本、精神力量之魂,其对国家治理体系和治理能力现代化目标的实现影响深远。从法理和政理视角来看,中华民族共同体意识的理论基础包括中国古代"大一统"理念、马克思主义经典作家关于"民族"的论述,以及近现代学者阐释的"中华民族"和"共同体"的概念等。在铸牢中华民族共同体意识的过程中,要正确认识和处理好三对辩证关系,即铸牢中华民族共同体意识与中国共产党领导珠联璧合的关系、与全面推进依法治国双向互动的关系,以及与单一制国家结构形式的实践同频共振的关系。铸牢中华民族共同体意识可以从两条路径上获得实现,一是思想共同体、制度共同体和文化共同体的共同构建,二是中华民族共同体、人类命运共同体、人与自然共同体的逐步推进。

The sense of community for the Chinese nation is a major proposition put forward by the CPC Central Committee with General Secretary Xi Jinping as the core,which is based on the summary of positive and negative historical experience and the study of the current domestic and foreign situation.As the basis of national unity and foundation of ethnic harmony,and the soul of spiritual strength in the new era,it has a far-reaching impact on the realization of the modernization of national governance system and governance capacity.From the perspective of jurisprudence and politics,the theoretical basis of the sense of community for the Chinese nation includes the concept of"great unity"in ancient China,the classical exposition of classic Marxist writers on"nation"and the concepts of"Chinese nation"and"community"explained by modern scholars.In the process of casting the sense of community for the Chinese nation,it is necessary to correctly understand and handle three dialectical relations,that is the relationship between the sense of community for the Chinese nation and the leadership by the Communist Party of China,the relationship between it and the two-way interaction in comprehensively promoting the rule of law,and the relationship between it and the implementation of the"unitary system"national structure.The sense of community for the Chinese nation can be realized in two ways:one is the joint construction of the ideological community,the institutional community and the cultural community,and the other is the gradual promotion of the Chinese community,the community with a shared future for mankind,and the community of man and nature.
