摘要
刑事诉讼法教学面对刑事司法的深度融合、程序正义的独立价值、社会化培训机构的发展和跨学科内容的碰撞,应将培养目标从传统的知识传授与视野开拓,转向对学生法律思维能力养成的侧重,方能凸显高等法学教育的比较优势。它离不开以能力训练为导向的案例教学来提供教学方法支持,即要求教师围绕规范性程序分析、多角度论证说理、全方位识别争点这三种基本能力,设计形成呈阶层、有递进的案例研习体系。
In the face of deep integration in criminal field,independent value of procedural justice,development of social training agencies,and collision of interdisciplinary knowledge,the criminal procedure law teaching should shift training objectives from knowledge instruction and horizons broadening to emphasize cultivating legal ideation,in order to highlight comparative advantage of higher legal education.It can hardly do without the case teaching oriented by capability training,which provides support in teaching method.That demands the teachers to aim at three basic abilities of normative analysis,multi-angle reasoning and problem spotting,designing a progressive research system composed of the criminal procedure law cases.
