法学实务课程教学改革的思考——以刑事诉讼法实务课程为视角

摘要 现阶段高等法学教育在本科阶段强化理论教学的同时,也越来越重视法学实务课程的开展,以此提高学生的实践能力,培养应用型法律人才。刑事诉讼实务是一门典型的法学专业实务课程,在法学实务课程中占有重要的地位。但是,刑事诉讼实务课程由于起步较晚,仍存在教学模式改革研究不深、实务课程缺乏理论支撑、教学方法比较单一等问题。因此,通过改善刑事诉讼实务课程教学模式,推行"合作式参与"教学模式,在师生之间形成平等的参与模式。引入双师型教师、法官、检察官三方座谈式教学方法,双师型教师主导下的座谈式授课,既保证实务课程的理论性知识的灌输,又丰富了学生的实践知识和实践技能,提升法学实务课程的完整性和高效性。 At the present stage of higher law education,while strengthening the theoretical teaching in the undergraduate stage,more and more attention is paid to the development of law practice courses,so as to improve students’ practical ability and cultivate application-oriented legal talents.Criminal Procedure Practice is a typical law practice course,which plays an important role in law practice course.However,due to the late start of the Criminal Procedure Practice course,there are still some problems such as the lack of deep research on the reform of teaching mode,the lack of theoretical support for the practice course,and the unitary teaching method.Therefore,by improving the teaching mode of Criminal Procedure Practice course,the "Cooperative Participation" teaching mode is implemented to form an equal participation mode between teachers and students.The introduction of double-qualified teacher,judge,prosecutor Talk-based teaching method,the double-qualified teachers under the guidance of teaching,not only to ensure the theoretical knowledge of practical courses,but also to enrich students’ practical knowledge and practical skills,improving the integrity and efficiency of law practice courses.
