海上钻井平台与用海活动的海洋法协调
摘要
海上钻井平台的建造和使用会对其他用海活动造成不同程度的影响。《联合国海洋法公约》等海洋法公约未能厘清海上钻井平台与其他用海活动的冲突。海上钻井平台对专属经济区内和公海捕鱼活动造成不利的影响,需要协调沿海国捕鱼权与开发海洋油气资源活动的冲突;专属经济区和公海的航行自由应优先于勘探开发海洋油气资源活动;铺设海底电缆和管道应尊重沿海国开发专属经济区和大陆架油气资源的权利;沿海国建造和管理的专属经济区内的海上钻井平台,仅在有限情形下可以限制其他国家或主管国际组织进行的海洋科学研究活动。
