《反腐败民法公约》:欧洲委员会的指引及罗马尼亚的立法回应
摘要
欧洲委员会指导出台了若干国际法律文件。除了最广为人知的受欧洲人权法院管辖的《欧洲人权公约》外,还有《反腐败民法公约》,它规定了缔约国的特定义务,包括调整国内法、出台对腐败造成的损害予以救济的相关规定。反腐败国家联合会(GRECO)负责监督缔约国对公约的实施情况。作为欧洲委员会的成员国之一,罗马尼亚承担公约项下的义务。本文旨在分析罗马尼亚立法与其承担的欧洲委员会《反腐败民法公约》项下义务的相符及不符之处。
