数智化时代下的算法治理——基于企业社会责任治理的重新审视

Algorithm Governance from the Perspective of Corporate Social Responsibility Governance in the Digital and Intelligent Era

数智化时代下算法的普及与应用场景的高度渗透性产生了新的社会问题。文章立足于企业社会责任治理的视角重新审视算法治理的全新逻辑,认为数智化时代的企业社会责任治理在企业社会责任治理主体、企业社会责任治理内容与治理范式等多个层面实现创新,且算法治理作为一种全新的企业社会责任治理对象衍生出一系列的新型企业社会责任治理重点议题,包括算法霸权与垄断、算法歧视、伦理与算法黑箱。文章重点从企业社会责任治理的视角,提出算法治理的全新逻辑起点需要重新审视算法与企业、算法与社会之间的关系,重新审视嵌入算法的"智能机器人"的决策主体合法性以及重新审视数智企业的社会责任内容维度,推演出三个核心命题,为数智化时代下算法治理提供新的逻辑框架。

The popularity of algorithms and the high penetration of application scenarios in the era of digital intelligence have brought about new social problems.Based on the perspective of corporate social responsibility governance,this paper re-examines the new logic of algorithmic governance.It holds that CSR governance in the era of digital intelligence has achieved innovation in CSR governance subject,CSR governance content and governance paradigm,and algorithmic governance as a new CSR governance object has given rise to a series of new CSR governance key issues,including algorithmic hegemony and monopoly,algorithmic discrimination,ethics and algorithmic black box.Finally,we discuss the new logic of algorithmic governance from the perspective of corporate social responsibility governance,which needs to re-examine the relationships between algorithm and enterprise and between algorithm and society;the legitimacy of decision-making subject of"intelligent robot"embedded in algorithm;and enterprises with new micro organizations including digital platform enterprises and artificial intelligence enterprises.From the content dimension of social responsibility,three core propositions are deduced to provide a new logical framework for algorithm governance in the era of digital and intelligent.
