摘要
在市场经济国家,政府规制工作时间存在两个相互矛盾的目标,即增强工时弹性和保护工时权利。工时制度是平衡与协调工时规制矛盾性目标的实现途径,直接影响企业的工时安排和劳动者的工时权利。文章选取欧盟、英国、日本及新加坡的工时制度进行比较分析。通过深入分析以上地区和国家工时制度的基本特征和工时规制的具体内容,文章总结了不同国家工时规制的内在逻辑,并以这些市场经济国家的历史经验为鉴,结合我国现阶段工时规制的发展特点,探求适合我国国情的工时制度,为新时代中国劳动关系治理现代化提出政策建议。
Market economies have to balance the working time flexibility and protection of labor rights,when regulating working time institutions.Working time institutions are argued to affect working time arrangements in companies and labor rights on working time.This article is based on a comparative study,by examining and contrasting working time institutions in the European Union,the United Kingdom,Japan,and Singapore.Drawing on the experiences from these countries or regions,this study offers suggestions on working time institutions in the Chinese context.
