“软暴力”违警现场警察执法语言应对探析

Analysis of Police Law Enforcement Language Response at the Scene of“Soft Violence”Violation

随着国家加大对暴力袭警行为的打击,近几年,暴力袭警行为正在逐年减少,特别是2021年3月1日《刑法修正案(十一)》增加“袭警罪”,将暴力袭警的判罚刑期进一步上调以来,更是对暴力袭警行为进行了有力的扼制。然而,正是这种环境使得“软暴力违警”现象逐渐增多,许多不法分子为避免承担违法后果,逃避打击,便采用手段相对柔和、方法相对隐蔽的“软暴力”阻碍民警执法。本文围绕“软暴力违警”的特点和类型,选择现场处置软暴力违警的执法语言应对角度展开研究和探讨。

With the increasing crackdown on violent attacks on police officers by the country,in recent years,violent attacks on police officers have been decreasing year by year.Especially since March 1,2021,the“Criminal Law Amendment(11)”added the“crime of assaulting police officers”and further increased the sentence for violent attacks on police officers,it has effectively curbed violent attacks on police officers.However,it is precisely this environment that has led to a gradual increase in the phenomenon of“soft violence violations of police”.Many illegal elements,in order to avoid bearing the consequences of the law and avoid cracking down,use relatively soft and covert methods to hinder police law enforcement.This article focuses on the characteristics and types of“soft violence violations of police”,and selects the perspective of law enforcement language response for on-site handling of soft violence violations to conduct research and exploration.
