Research on the Fee Base Problem of Standard Essential Patent Authorization(SEP)for Cellular Mobile Communication Industry

自上而下法是测算标准必要专利许可费的重要方法,确定合理费基范围尤为关键。本文对通信行业标准必要专利授权中涉及的费基问题做了全面、系统的阐述,总结出甄别合理费基的几条原则,包括需求基础原则、假设市场谈判原则等。在测算手机的费基时,以往采用整体市场价值规则和最小可售实施专利单元两种常规授权模式都是极端的做法,合理的费基应当介于两者之间。基于传统的自上而下法,本文构建一种合理的费基模型,并通过向行业专家进行问卷调查的方式计算合理的费基。结果发现:以整体市场价值规则确认费基的方法高估了实际专利贡献,其高估程度达到3.65-4.7倍,合理费基仅为整个市场价值的20%-30%。本研究有助于为标准必要专利许可的司法实践提供新的理论视角。

The top-down method is an important method for calculating standard essential patent licensing fees,while determining a reasonable fee base range is particularly crucial.This article provides a comprehensive and systematic explanation of the fee base issues involved in the standard essential patent authorization of communication industry,and summarizes several principles for identifying reasonable fee bases,including the demand based principle and the hypothetical market negotiation principle.The traditional licensing models of using the overall market value rule and the minimum saleable implementation patent unit are both too extreme to calculate the fee base of mobile phones,thus a reasonable fee base should be between the two.Based on the traditional top-down approach,this article constructs a reasonable fee base model and calculates the reasonable fee base by conducting a questionnaire survey with industry experts.The results showed that the method of confirming the fee base based on the overall market value rule overestimated the actual patent contribution,with an overestimation degree of 3.65-4.7 times,and the reasonable fee base is only 20%-30%of the entire market value.This study helps to provide a new theoretical perspective for the judicial practice of standard essential patent licensing.
