数字经济背景下加强平台经济领域反垄断面临的挑战与建议

Challenges and Suggestions on Strengthening Anti-monopoly in Platform Economy under the Background of Digital Economy

平台作为数字经济的重要载体,也是数字经济新业态的组织形式。通过对数字经济条件下平台定位、功能的研究发现:平台的发展对于优化资源配置、促进技术创新及实现产业跨界融合等方面具有积极作用。但是,在技术的推动下,平台的发展对垄断协议规制、滥用市场支配地位规制以及经营者集中规制等带来了新的挑战。由此,监管机构在反垄断规制过程中,应以构建多元化的算法共谋规制体系,完善相关市场判定标准,构建申报和审查相结合的合并规制体系,以实现经济效率和社会福利的双提升。

As an important carrier of digital economy,platform is also the organizational form of new format of digital economy.Through the research on the positioning and function of the platform under the condition of digital economy,it is found that the development of the platform plays a positive role in optimizing resource allocation,promoting technological innovation and realizing cross-border integration of industries.However,promoted by science and technology,the development of the platform has brought new challenges to the regulation of monopoly agreement,abuse of market dominance and concentration of operators.Therefore,in the process of anti-monopoly regulation,regulators should build a diversified algorithm collusion regulation system,improve relevant market judgment standards,and build a merger regulation system combining declaration and review,so as to achieve double promotion of economic efficiency and social welfare.
