论我国中小学教育惩戒过程中的教师能动性

摘要 我国中小学教师教育惩戒的积极性、灵活性构成其能动性,体现于教师对学生违纪事实的核实及对教育惩戒措施的选择、适用过程中。当前我国部分教师因顾虑被惩戒学生实施极端行为、提出体罚认定而不敢进行教育惩戒;也有部分教师由于对惩戒规则认识不全面,追求惩戒功效而忽视了教育惩戒应有的灵活性。为更好地实现教育惩戒的立法目的,应加强教育惩戒行为的执法保护并设立教育惩戒校园帮助机构,以激发中小学教师教育惩戒的积极性;可通过完善教育惩戒规则学习制度来督促中小学教师掌握正确的教育惩戒方式,从而提升中小学教师教育惩戒的灵活性。 In the process of educational discipline,the primary and secondary school teachers'initiative include their activeness and flexibility,which always reflect in the verification of the facts of students'disciplinary violations,and the choice and implementation of the measures of educational discipline.At present,some primary and secondary school teachers are afraid to implement educational discipline because they are worried about the extreme behavior of the students being punished and the accusation of corporal punishment.There are also some primary and secondary school teachers ignoring the flexibility of educational discipline due to one side knowledge of the discipline rules and for the pursuit of the efficacy of disciplinary action.In order to better realize the purpose of the legislation on educational discipline,we should strengthen the legal protection to the educational discipline and improve the treatment of head teachers for improving the activity and flexibility in the course of educational discipline.Besides,we should improve the learning system of educational discipline rules to urge primary and secondary school teachers to master the correct way of educational discipline so as to enhance the flexibility of educational discipline of primary and secondary school teachers.
