教育法法典化功能的现实定位

摘要 教育法典应当直面社会诉求,以客观法律秩序为编纂的基本线索,从政府职能定位角度回应新时代社会基本矛盾,厘清当下多元化、多层次的教育法律关系。全面性、稳定性、明确性是法典的优势,但是要保障法典的科学性、有效性、可持续性,必须客观理解法典化功能的局限性,处理好法典与其他调整工具的衔接问题。当前,通过法典化整合不同时期、不同部门、不同位阶的教育规范性文件,对改革中已经形成或正在形成的基本制度予以明确,是教育法典的重要功能。 Education code should face the demands of the society,take the objective legal order as the basic clue of compilation,respond to the basic contradictions of the society in the new era from the perspective of government function positioning,and clarify the current diversified and multi-level educational legal relations.Comprehensiveness,stability and clarity are the advantages of education code.However,in order to ensure its scientificity,effectiveness and sustainability,it is necessary to objectively understand the limitations of the function of codification and properly handle the connection between education code and other adjustment tools.At present,it is an important function of education code to make clear the basic system formed or being formed in the reform by codifying and integrating educational normative documents of different periods,departments and levels.
