摘要
修复性司法鼓励人际修和,关注冲突对多层次人际关系的伤害和伤害后的处理过程,其对受害者权利的强调和同伴关系的弥补与校园欺凌损坏身心健康、破坏学生关系的本质特征相吻合;沟通、弥补、愈合思路所蕴含的平衡精神与学校的教育目标相贴合。修复性司法用于校园欺凌治理的基本要求是欺凌者、被欺凌者、学校等各方共同参与来承认被欺凌者的权利和需求,鼓励欺凌者承担责任。实践中,根据校园欺凌的案件性质可使用调解模式或会议模式,并采用以被欺凌者为焦点的对话驱动型策略,同时可通过强化教育学习的预先性实践和应对伤害与恶行的反应性实践来扩展学校层面的欺凌防治。
Restorative justice promotes interpersonal reconciliation,concentrating on the harm caused by conflicts in multidimensional relationships and the treatment process.Restorative justice emphasizes the rights of the bully-victims and the remedy of peer-to-peer relations,which is consistent with the nature of school bullying as damaging to students'physical and mental health and companionships.The spirit of balance and peace that underlies its basic idea of communication,remedy and healing is coinciding with the schools'educational objectives.The fundamental requirement for restorative justice to be applied in school bullying practices is the involvement of the bullies,the bully-victims and the school to recognise the rights and needs of the victims and encourage the bullies to shoulder the responsibility.According to the different types of cases,a mediation mode or a conference mode can be adopted with a victim-centered and conversation-driven strategy.And schools provide a natural setting for the application of restorative justice,which can extend school-level bullying prevention and control on campus by reinforcing advanced practices in educational learning and responsive practices for coping with harm and mischief.
