论教育法典的体系化

摘要 教育法典体系化是教育法法典化研究的重要内容,其既包括教育法典内部的体系化,也包括教育法典和外部教育法律系统在体例结构方面的相互衔接与和谐统一。教育法典的体系化应当以潘德克顿学说为体系建构依据,采用统一立法的模式,以受教育权保护为立法逻辑,以总分模式建立起教育法典的基本框架体系。在教育法典的体系化过程中还应当处理好教育法典与其他相关立法的关系,汲取其他国家教育法法典化的先进理念与其他领域立法法典化的成功经验,充分结合我国国情和教育现状,建构具有中国特色的教育法典体系框架。 The systematization of education code is an important content in the study of the codification of education law.It includes not only the systematization of the interal education code,but also the mutual connection and harmonious unity of the style and structure between the education code and the external education legal system.The systematization of education code should be based on Pandekton's theory,adopt the model of unified legislation,take the protection of the right to education as the legislative logic,and establish the basic framework system of education code with general-and-specific model.In the process of systematization of education code,we should also deal with the relationship between education code and other relevant legislation,learn from the advanced ideas of education code in other countries and the successful experience of codification in other fields,and fully combine China's national conditions and education status to construct the framework of education code system with Chinese characteristics.
