摘要
在我国台湾地区,教育惩戒具有双重法理基础:法治理念下的在学关系确定教育惩戒的权力来源,教师专业自主确定教育惩戒的自由裁量特征。根据性质不同,教育惩戒可以划分为教师惩戒行为和学校惩戒处分两种类型,每一种类型均包括多种惩戒方式。教师惩戒行为需要部分遵循正当程序,学校惩戒处分需要全面遵循正当程序。台湾地区的中小学教育惩戒制度的借鉴价值在于:设计教育惩戒和纪律处分方式需要尊重学生的受教育权,实施教育惩戒和纪律处分需要合理遵循正当程序。
In Taiwan,China,educational discipline has a dual legal basis:the studentship under the concept of rule of law determines the power source of educational discipline,and professional autonomy of teachers determines the discretionary characteristics of educational discipline.According to the nature,educational discipline can be divided into two types:disciplinary behavior of teachers and disciplinary punishment of schools,each type includes a variety of disciplinary methods.Disciplinary behavior of teachers need follow due process in part,and disciplinary punishment of schools need follow due process in an allround way.The enlightenment of educational discipline system of primary and secondary school in Taiwan,China lies in:the design of disciplinary behavior of teachers and disciplinary punishment of schools need respect students’right to education,and the implementation of disciplinary behavior of teachers and disciplinary punishment of schools need follow due process reasonably.
