我国家庭教育管理体制的困境及其立法规制

The Dilemma of the Family Education Management System in China and Its Legal Regulation

一个职权责明晰的家庭教育管理体制有利于构建覆盖城乡的家庭教育指导服务体系。当前家庭教育管理呈现“九龙治水、各自为政”的困境,家庭教育工作事务繁杂,涉及的部门众多,协调成本高,妇儿工委和家庭教育工作联席会议都属于议事协调机构,权威性不足,妇联作为群团组织,本身没有行政执法权。要突破家庭教育管理的困境,应建立健全同级妇儿工委领导下的家庭教育工作联席会议制度,提高其行政权威,赋予联席会议议事决策权力,同时要建立按照机构划分的家庭教育管理责任清单制度,明确各个机构的职权责划分。

Constructing a family education guidance service system covering both urban and rural areas relies on a family education management system with clear duties and responsibilities.The current family education management presents the dilemma of separate governance.Family education affairs are complicated,involving many departments and high coordination costs.The working committee on children and women and the joint conference on family education are deliberative and coordinating bodies,which lack authority.As a group organization,the Women’s Federation has no administrative law enforcement power.It is necessary to break through the dilemma of family education management,establish and improve the joint conference system on family education under the leadership of the working committee on children and women,improve administrative authority,give the joint conference the power to make decisions,and establish family education management responsibilities list divided by institutions to clarify the division of duties and responsibilities of each agency.
