我国地方家庭教育立法内容分析

The Content Analysis on Local Family Education Legislation in China

近年来,家庭教育受到国家的重视,家庭教育立法工作如火如荼展开,地方家庭教育立法先试先行,重庆、贵州、山西等地陆续出台家庭教育促进条例,对家庭教育的定义、任务、立法目的与依据、管理体制、激励保障机制、特殊困境家庭教育、问责机制等七个方面做出了规定。地方家庭教育立法为家庭教育提供了法律保障,但仍有具体细节需要完善。《中华人民共和国家庭教育促进法》进一步明确了家庭教育的内涵,有利于切实推进家庭教育相关主体的权益保障,推动家庭教育立法,地方家庭教育立法应以此为指引进一步完善。

In recent years,our country has begun to attach importance to family education,and the legislative work of family education is in full swing.Local family education legislation takes the lead,some provinces such as Chongqing,Guizhou,Shanxi have successively issued family education promotion regulations and defined the definition,task,legislative purpose and basis,management system,incentive and guarantee mechanism,special hardship family education and accountability mechanism.Local legislation provides legal protection for family education,but the specific details need to be improved.The national legislation needs to clarify the connotation of family education,based on practical problems,change the legislative concept,effectively promote the protection of the rights and interests of the subjects related to family education,attach importance to the connection with relevant legal provisions,and promote the development of family education legislation.
