摘要
地方教育立法是教育法治的重要构成。现行地方教育立法在立法功能、调整内容以及法规制定过程方面存在"三重三轻"现象。有效发挥地方教育立法的保障和促进作用,需要协调好实施法律与创制法规、约束公权与保障多主体权利、教育部门主导与多部门联动三对关系。
Local education legislation is an important component of the rule of law in education.The current local education legislation has the phenomenon of"triple emphasis and contempt"in the aspects of legislative function,adjustment content and formulation process.In order to give full play to the guarantee and promotion function of local education legislation,three pairs of relations as following need to be coordinated:law enforcement and regulation creation,public power's restriction and multiple subjects'right protection,and education sector's leading and multi-sector's linkage.
