摘要
本研究对452份规范教育活动的法律、法规和规章文本的质性分析显示,虽然我国法律并未明示宣告公民的教育选择权,但是现行法律在教育活动的不同方面,不同程度地保障公民在若干具体教育事务中的选择权,并且这类权利的行使范围具有进一步扩大的可能性。立法对这类权利的规定伴生于教育的市场化运作和对公民就学机会平等的促进,具有零散授权的形式特征和工具价值为主导的价值特征。当前亟须以人为本,从回归教育的本源意义的角度来认识教育选择权的本体价值,结合公共教育资源的当下状况和发展预期,加强对该权利的保障。
By the methodology of qualitative analysis,this research analyzes 452 texts of laws,administrative regulations and rules which regulate educational activities.Result reflects that although there is no provision declares the right to education choice definitely,current legal system protects the right to choice in some education affairs in different degrees.Moreover,the scope of this right has possibility to be expanded.However,the generation and development of this right associate to the operation of education market and the promotion of the equality opportunity of getting education,and forasmuch,the structure of it is scattered and the dominant value of it is instrumental.There is an urgent need to cognize the value of the right to education choice from the origin of education,to systematically protect this right according to the current situation and anticipation of public education resources.
