Discussion on the Connotation of Minors’ Right to Development

未成年人发展权具有发展权的一般特性,但又具有其自身的特殊性。已有研究未能全面揭示未成年人发展权的内涵。本研究结合对未成年人的特殊性的认识以及未成年人发展的内涵,揭示未成年人发展权是一项具有母体性特征的权利,它构成未成年人立法的价值目标。未成年人发展权这一价值具体化为法律规范时应从未成年人身体发展的保护、智力发展的保护以及德性发展的保护入手,并以此分配国家、社会、家庭和个人不同主体的权利和义务。

Minors’right to development possess general characteristics of the right to development,and also has its particularity.The existing research failed to reveal the connotation of minors’right to development.The article holds that minors’right to development is a mothers’right,which is a basic and maternal right.It is the objective value of minors legislation.As a value,minors’right to development should be specific to the legal norms,which should be carried out around the protection of the different aspects of the minors’development,so as to standardize the obligations and legal responsibilities of different subjects.
