摘要
在传统自上而下的教育制度供给背景下,残疾人对自身受教育权的创设、实现及保障缺乏必要的参与,其主体性难以得到有效发挥,进而导致残疾人受教育权缺乏有效保障。为了保证残疾人受教育权的主体性,实现残疾人作为受教育主体的权利,有必要对残疾人受教育权进行主体性建构,在遵循国家义务、权利优先和参与程序等原则的前提下,健全残疾人受教育权义务主体保障体系,完善残疾人受教育的程序性权利,强化残疾人受教育权的主体参与和建立多元化的残疾人受教育权救济制度体系,从根本上为残疾人教育事业发展提供法治保障。
Under the background of traditional top-down educational system supply,the disabled lack necessary participation in the creation,realization and guarantee of their right to education,and their subjectivity cannot be efficiently displayed,which leads to the fact that their right to education cannot be effectively guaranteed.In order to ensure the subjectivity of the disabled’s right to education and realize their rights as the main body of the education,it is necessary for us to construct subjectivity of the right to education for the disabled.Under the premise of following the principles of state obligations,priority of rights and participation procedures,we should improve the guarantee system for the compulsory subject of the disabled’s right to education,improve their procedural right to education,strengthen their subjective participation and establish a diversified relief system of the right to education for them,thus radically providing law guarantee for the development of educational undertakings for the disabled.
