On the Obligation of Students’ Personal Information Security Protection of Educational Administrative Subjects under the Big Data Environment

在大数据环境下,我国与教育行政主体相关的侵犯学生个人信息安全的案件日益增多。教育行政主体的学生个人信息安全保护义务应为行政法律义务,然而现有立法中缺乏明确和全面的规定。应遵循信息保护义务的路径,从纵向和横向两个方面界定其具体内涵。

Under the big data environment,there are increasing cases of infringement of students’personal information security related to educational administrative subjects in China.The obligation of students’personal information security protection of educational administrative subjects should be an administrative legal obligation.However,the existing legislation lacks clear and comprehensive regulations.The path of information protection obligations should be followed,and its specific connotations should be defined in both vertical and horizontal directions.
