农村"三块地改革"涉及国家基础性制度建设,并关乎广大农村居民的切身利益,这其中,农村土地征收、集体经营性建设用地入市已步入发展的快车道,唯有宅基地改革的推进较为迟缓。由此导致了实践中游离法律之外的隐性流转现象突出,司法实务中裁判结果冲突不断,宅基地财产属性难以兑现。究其原因,宅基地三权分置法律体系尚待落地,政策语言还未完成向法律规范的转换是问题痛点。因此,应当结合各地有效经验,从法律层面予以规制,真正做到落实宅基地集体所有权,保障宅基地农户资格权,适度放活宅基地使用权。

The rural"three-piece land reform"involves the construction of national basic system and the vital interests of the majority of rural residents.Among them,rural land expropriation and the entry of collective operating construction land into the market have entered the fast lane of development,but the progress of homestead reform is relatively slow.Consequently,the phenomenon of hidden circulation outside the law is prominent,the results of judicial practice conflict constantly,and it is difficult to realize the property attribute of homestead.The reason is that the legal system of the separation of the three rights of homestead has not yet to be implemented,and the policy language has not yet completed the transformation to the legal norms.Therefore,it is necessary to combine the effective experience of various regions to regulate from the legal level,truly implement the collective ownership of homesteads,protect the qualification rights of homestead farmers,and appropriately release the usufruct of homestead.
