The Intellectual Property of the Output of Artificial Intelligence from the Perspective of a New Classification

在人工智能的时代背景下,以人为中心建构的传统知识产权体系,与以人机关系为关注焦点的人因工程学存在天然联系。人机交互过程中人工智能输出成果与人类相关,却日渐呈现人类参与度不断降低的趋势。依据人类与机器的不同控制强度在输出成果中的体现,我们可以将人工智能输出成果分成既定反馈、协作反馈和智能反馈,并在此基础上分析人工智能输出作品的可版权性和发明的可专利性。

Under the background of the era of artificial intelligence,the traditional intellectual property system constructed with people as the center has a natural connection with human factors engineering with human-machine relationship as the focus.In the process of human-computer interaction,the output of artificial intelligence is related to humans,but it is gradually showing a trend of decreasing human participation.According to the manifestation of different control strengths of humans and machines in the output,we can divide the output of artificial intelligence into established feedback,collaborative feedback,and intelligent feedback,and on this basis,the copy right ability and paten tability of the output of artificial intelligence are analyzed.
