摘要
由于我国经济、社会、历史和法律制度等方面的因素,长期以来对违法建筑问题并未太过于重视。此外,由于民众法律意识淡薄、居住条件较差和追求经济利益等因素,种种原因叠加导致违法建设行为愈演愈烈,违法建筑数量大幅度增加。从法律上来看,违法建筑因其建造行为违反建筑管制之公法,从而被公法否定评价。但是从私法角度来看,违法建筑不仅是一种事实上的财产,还是一种私法上的物,需要法律给予一定程度的保护。而违法建筑的转让、租赁、抵押及损害赔偿等,也在一定程度上体现了其财产属性。
Due to the factors of economy,society,history and legal system,the problem of illegal construction has not been paid too much attention for a long time.In addition,due to the weak legal awareness,poor living conditions and the pursuit of economic interests and other factors,the combination of various reasons leads to the intensified illegal construction,and the number of illegal buildings has increased significantly.From the legal point of view,the illegal construction is negated by the public law because its construction behavior violates the public law of construction control.But from the perspective of private law,illegal construction is not only a kind of property in fact,but also a kind of property in private law,which needs a certain degree of protection from the law.The transfer,lease,mortgage and compensation for damages of illegal buildings also reflect their property attributes to a certain extent.
