Research on Parole System and Its Application in the New Situation

当前制度下,我国假释制度在实务工作中存在适用条件、适用程序、问责机制、再犯罪评估机制等方面的问题,社会回归功能很难得到有效发挥,因此,完善假释立法,增强依法扩大假释适用的条件和操作性,健全社区矫正工作机制和假释制度衔接,扩大假释适用的主动权等,是推进假释制度完善及应用的有效进路。

Under the current system,China’s parole system has problems in terms of application conditions,application procedures,accountability mechanism,and crime assessment mechanism in the physical work,so it is difficult to effectively play the function of social return.Therefore,we should improve parole legislation,strengthen the conditions and operability of expanding the application of parole according to law,improve the connection between community correction mechanism and parole system,and expand the application of parole,which are effective way to promote the perfection and application of parole system.
