《社区矫正法》的立法价值取向和内在立法精神蕴含了社区矫正工作的新理念,使社区矫正工作呈现出立法基础的实践性、价值取向的人文性、法律地位的独立性、参与主体的法定性等新特征。因此,必须对社区矫正的工作流程、体制机制、管理制度、教育模式等进行法治化审视。同时,按照政治引领、法治保障、德治教化、自治强基、智治支撑的基本路径,对社区矫正工作的发展趋势作出新的判断。

The legislative value orientation and intrinsic legislative spirit of the Community Correction Law contain the new idea of community correction work,which makes the community correction work present some new features,such as the practicality of legislative basis,the humanistic nature of value orientation,the independence of legal status,and the legality of participants.Therefore,it is necessary to examine the working process,institutional mechanism,management system and education mode of community correction under the rule of law.At the same time,according to the basic path of political guidance,legal guarantee,moral education,autonomy and intellectual support,we can make a new judgment on the development trend of the community correction.
