摘要
突发公共卫生事件应对法以提升突发公共卫生事件应对效率为主要立法目的,除发挥对应急主体的控权功能外,其主要为应急主体在应对突发公共卫生事件时,设定连贯的行为指引。完善突发公共卫生事件应对法的相互衔接,实现法律之间的贯通一致,要求立法主体明确各类法律的立法定位和立法内容。还应当避免重复立法、完善空白立法、防止法律冲突。
The public health emergency response law aims to improve the efficiency of responding to public health emergencies.In addition to exerting the power control function of the emergency subject,it is mainly used for the emergency subject to set coherent behavior guidelines when responding to public health emergencies.To perfect the connection degree of public health emergency response law and enhance the consistence between laws,itrequires the legislative subject to make clear the legislative position and legislative matters of all kinds of laws.Besides,we should also avoid repeating legislation,perfect blank legislation,and prevent conflicts of laws.
