系统治理视域下“扫黑除恶”斗争长效机制构建

Construction of a Long-term Mechanism for “Crime crackdown” from the Perspective of Systematic Governance

黑恶势力犯罪是古今中外的治理难题,其产生机理主观上有犯罪普遍具有的人性因素,客观上有其独特的犯罪形式所依赖的经济社会基础。与国外打击有组织犯罪不同,我国在打击黑恶势力犯罪的程序上可分为四个阶段:因针对新兴的黑恶势力犯罪现象引发,以出台刑事政策启动,以修改法律制度推动,以刑事政策与刑事法律稳定有效发挥作用而告一段落。在当前"扫黑除恶"取得重大成果的基础上,应在刑事政策导向上明确长效机制的目标,达到可防可控的目的。基于系统治理的思路,可将"扫黑除恶"斗争作为一个系统加以分析,构建长效机制,包括:明确"扫黑除恶"斗争工作系统的界限,对黑恶势力不纵不枉;发挥"扫黑除恶"斗争工作系统的要素功能,对黑恶势力依法严惩;畅通"扫黑除恶"斗争工作系统的反馈渠道,对黑恶势力犯罪新手段及时施策;优化"扫黑除恶"斗争工作系统的环境,遏制黑恶势力滋生源头。

Gangland crime is a difficult governance problem in ancient and modern times both at home and abroad.Its production mechanism is subjectively based on the universal human element of crime,and objectively has the economic and social foundation on which its unique crime form depends.Different from the fight against organized crime abroad,the fight against the gangland crime in China can be divided into four stages in the process:in response to the emerging phenomenon of the gangland crime,to launch a criminal policy,to amend the legal system to promote,and it ended with the stable and effective functioning of criminal policy and criminal law.On the basis of the great achievements made in the current"crime crackdown",the goal of the long-term mechanism should be defined in the direction of criminal policy so as to achieve the aim of prevention and control.Based on the idea of systematic governance,we can analyze the"crime crackdown"struggle as a system and construct a long-term mechanism,including:clarify the boundaries of the work system of"crime crackdown"struggle,not to indulge the underworld forces in vain;exert the essential functions of the"crime crackdown"struggle work system,and severely punish the underworld forces in accordance with the law;unblock the feedback channels of the"crime crackdown"struggle work system,and take timely measures against the new means of the underworld forces;and optimize the environment of the"crime crackdown"struggle work system to curb the source of the underworld forces.
