黄河沿岸滩区的规划变迁、法治进程与治理体系

The Reform Procession of Plan,Legal and Governance System in the Yellow River Beach

2019年9月,习近平总书记在黄河流域生态保护和高质量发展座谈会上提出了"以水而定、量水而行、因地制宜、分类施策"和"抓好大保护、推进大治理"的要求,引领了黄河流域的空间规划、法治进程与治理体系的共生促进与相互融合的方向。黄河沿岸村镇与"黄河滩区""黄河故道""黄河湿地"等国土资源高度重叠而自成体系,近二十年来国土规划主题历经"滩区建设""精准扶贫""特色小镇""生态保护"的数次演变,同期我国预算法、招标投标法、政府投资条例、城乡规划法、环境保护法的制定与修订也勾画出法治进程的轮廓,沿岸农村治理体系也产生了深刻的变化,由此构成了"规划—法治—治理"的互动关系,有望形成新时期"水治文明",其核心在于价值理念上的"从善如流"与体制机制上的"因势利导",以促进沿岸村镇群众的"重叠共识",形成法治的"软环境"并启动"诱致性"制度变迁与文明进步。

At the end of 2019,General Secretary Xi Jinping put forward the requirements of water to be determined and used,measures to be taken according to local conditions and classification,great protection and governance to be promoted at the Yellow River basin ecological protection and high-quality development symposium,which leads the diretion of the promotion and mutual fusion of the spatial plan,legal and governance system in the Yellow River Beach.Villages and towns alongside the Yellow River,also called the floodplains,the original course,and the wetlands,overlapped into an independent self-system upon their land resources.The theme of plan on projects changed as"flood infrastructure","poverty alleviation","characteristic towns"and"ecological protection"in recent two decades,together with the legislations and amendments of the law issued as budget,tenders and bids,government investment,urban and rural plan,environmental protection,converged into the progressive path of governance system.The interaction between the plan,the law,and the governance formed into a sort of water-typed civilization around the virtue by moral enlightenment and beneficial guidance,thus aroused amiable commonsense and soft-circumstances from the inhabitants,induced further progression of civilization and improvement of institution spontaneously.
