《食品安全法》与《进出口商品检验法》衔接研究

A Study on the Connection between Food Safety Law and Law on Import and Export Commodity Inspection

《食品安全法》和《进出口商品检验法》同为海关进出口食品安全监管的执法依据,但由于历史原因,两者存在一些不衔接的地方。因此,在对两者间部分不衔接问题进行分析的基础上,提出了食品安全法修订建议,包括增加按照国际多双边协议对出口食品实施检验的条款,允许标签、标志或者说明书不符合食品安全标准的进口食品整改合格后进口,进口食品检验复验采取与国内食品监督抽检复检相同的程序,明确进口食品经销商、代理商与进口商在食品安全方面同等的行政法律义务,并删除《商品检验法实施条例》有关进出口食品企业卫生注册的条款。

Food Safety Law and the Law of Import and Export Commodity Inspection are both legal bases for the law enforcement in the import and export food safety supervision of the Customs.Due to historical reasons,there are some disjointed places between them.After analyzing the disjointed points,the paper puts forward some suggestions about the revision of Food Safety Law,including adding terms about export food inspection in accordance with the international multilateral agreements;allowing the food to import after rectification of label,logo,or instructions which do not conform to the food safety standards;taking the same procedures of reinspection and sampling for imported food inspection as those of supervision and sampling for the domestic food;specifying the same legal obligations for the imported food distributors,agents and importers;removing the terms of the sanitary registration of traders for import and export food included in the Implementation Regulations of the Law on Import and Export Commodity Inspection.
