论挂靠船舶的物权法律问题

On the legal issues of the property real rights of the affiliated ships

以我国航运实践中普遍存在的船舶挂靠经营现象所出现的挂靠船舶的物权法律问题为题,结合司法实践中挂靠船舶物权纠纷的争议焦点和法院判例,以及理论中挂靠船舶物权问题的研究成果,总结挂靠船舶物权纠纷的裁判观点,比较挂靠船舶与一般特殊动产在物权变动中的共性与个性,分析挂靠船舶在所有权归属、所有权变动及抵押权设定中存在的物权法律问题,为挂靠船舶物权法律问题的统一认识,以及纠纷裁判规则的统一提供理论参考。

This dissertation focuses on the legal issues of the affiliated ship's property real rights,combining the focus of disputes of the affiliated ship's property real rights in the judicial practice in China and the theoretical research on the legal issues of the affiliated ships,to summarize the opinions of the various judgments of the property real rights disputes of the affiliated ships,and to compare the commonalities and individualities of the affiliated ships and the general special movable property in the change of property real rights,and to analyzes the legal issues regarding the ownership,the changes of ownership and the establishment of mortgage on the affiliated ships,for the purpose of providing a theoretical reference for the unification of the judgment rules for the property real rights disputes of the affiliated ships in China.
