摘要
航运业作为自由贸易港所涵盖市场范围内的一个重要子市场,其法律制度的构建应遵循自由贸易港"先立法,后设港"整体法治建设的步伐。基于我国自由贸易港是自贸试验区的升级版,其航运政策与法规的制定与实施理应在自贸试验区现有成果的基础上创新与改革,同时应从国际自由贸易港先进立法例中吸收立法模式与具体制度上的经验。自由贸易港航运法治建设需研究其必要性、应遵循的原则、适宜的立法模式,并在此基础上对应重点规制的部分进行制度设计。
Shipping is an important sub-market within the market covered by a free trade port.The establishment of shipping legal system shall keep pace with the overall rule of legal construction in the free trade port,i.e."legislating before setting up a port".In view of the fact that China’s free trade ports shall be an upgraded version of the pilot free trade zones,the formulation and implementation of its shipping policies and regulations shall be based on the achievements of the pilot free trade zones to innovate and reform.At the same time,it shall also make reference to the legislative mode and specific institutional experience from the advanced legislations of free trade ports in other jurisdictions.To construct the shipping legal system in the free trade ports in China,it’s essential to study the necessity,the principles and the legislative modes as well as the system design of some important parts that should be regulated.
