摘要
由于包括条件说、合法则的条件说、相当因果关系说、客观归责理论在内的传统因果关系认定学说存在着过度扩大或限缩行为与结果的因果关系的问题,因而无法直接将其照搬套用于元宇宙中的实行行为与现实中的危害结果之间的因果关系认定。考虑到即使存在着介入因素等特殊情形,危险的现实化学说仍提供了可用于判断实行行为与危害结果的复杂因果关系的方法论,因此在对元宇宙中因果关系论的认定分析的基础上,对危险的现实化学说进行修正,提出了一种关联行为与结果的辨识框架体系,并在涉及行为后的特殊情形时,通过修正的危险的现实化学说的两条认定路径,来辨明行为与结果的因果关系。该体系中由于统一了归因和归责使得因果关系认定路径在故意犯罪中可以合理地认定行为与结果的关联,且在过失犯中也能适用。
Due to the problems of excessive expansion or limitation of behavior and causal relationships in the traditional causal relationship determination theory,including the conditional theory,the legal conditional theory,the equivalent causal relationship theory,and the objective attribution theory,it cannot be directly applied to the causal relationship determination between the implementation behavior in the metaverse and the harmful results in reality.Considering that even in the presence of special circumstances such as intervention factors,the realistic chemical theory of danger still provides a methodology that can be used to determine the complex causal relationship between the implementation of behavior and the consequences of harm.Therefore,based on the analysis of the causal relationship theory in the metaverse,this article modifies the realistic chemical theory of danger and proposes a framework system for identifying the correlation between behavior and results.When dealing with special situations after behavior,the causal relationship between behavior and results is identified through the two identification paths of the modified realistic chemical theory of danger.Due to the unified attribution and attribution in this system,the causal relationship determination path can reasonably determine the relationship between behavior and result in intentional crimes,and can also be applied in negligent crimes.
