论家事司法的愈疗功能

家事司法的愈疗功能是指在不影响司法公正和司法效率等家事司法基本价值的前提下,家事司法应尽可能减少对当事人以及案件所涉的未成年子女的心理方面的伤害,帮助当事人以及案件所涉的未成年子女纾解负面情绪,从而使得愈疗效果最大化和反愈疗效果最小化。我国家事司法的愈疗功能的确立既是应对家事案件特殊性的要求,又是落实家事司法人性化的要求;家事司法的愈疗功能的确立既是我国实践经验的总结、提炼和升华,又具有法学理论支撑。为实现家事司法的愈疗功能,需要构建愈疗性家事审判制度、完善家事调解制度、健全家事司法中的婚姻家庭辅导制度、确立家事司法中的心理疏导制度,同时,要求转变法官和律师等法律工作者的态度、行为和角色。
