相对贫困治理下基本公共服务均等化的法治逻辑与权利构建

Logic of Rule of Law and Right Construction of Equalization of Basic Public Services:From the Perspective of Relative Poverty Governance

我国已经进入相对贫困治理阶段。基本公共服务能够增强相对贫困人口的可行能力,缩小城乡区域群体差距,缓解相对贫困,激发高质量发展内生动力。推进均等化是我国迈向社会法治国,实现社会公平正义,保障公民平等发展权的内在要求。当前基本公共服务均等化面临法治阙如的困境,可探索构建公民共享权,并以服务型政府的给付义务为支撑。在宪法社会主义原则和共享发展理念的指引下,我国需制定专门的均等化法律,对相关社会性法律进行系统性调整,形成以基本公共服务均等化推动相对贫困治理的法治格局,逐步实现全体人民共同富裕。

China has entered the stage of relative poverty governance.The basic public services enhance the capability of relative poor people,meanwhile,narrowing the gap between urban and rural areas,different groups and regions.The equalization of basic public services alleviates relative poverty and activates endogenous power of high quality development.It is the inherent requirement towards social state under the rule of law,which promoting social justice and ensuring the equal right to development of people.The equalization of basic public services is short of legal regulation in nowadays.We can explore the construction of people'shared rights,which supported by the payment obligations of service-oriented government.Under the guidance of socialism principle and shared development concept,we needs to formulate special law and systematically adjust relevant social law.Finally our country forms setup in the rule of law which promotes the governance of relative poverty and gradually realizes the common prosperity.
