河北省醉酒型危险驾驶罪的量刑活动有四个特点:拘役刑判罚较轻且不同月数刑期对应的均衡性不一致,拘役刑期对罚金刑的判处具有决定性影响,缓刑裁量活动相对更具规范性,酒精含量是量刑的核心考察要素。整体来看,对量刑活动具有现实影响力的因素较少,不同犯罪行为对应的量刑结果差异不大。原因在于结果意义上看本罪社会危害性轻微,刑法规范供给的量刑资源不充足,以及直接彰显驾驶行为危险性的证据材料匮乏。可以采取以下措施进一步规范量刑活动:一是以非绝对化的酒精含量标准搭配不同违章行为建构基本的量刑框架;二是通过“但书”“不起诉”“免罚”“缓刑”和“实刑”构筑具有实质差异性的量刑体系;三是通过刑事诉讼标准全面规范行政人员的证据搜集活动以保证量刑活动的公正性。

The sentencing activities of the crime of drunken dangerous driving in Hebei Province have four characteristics:the sentence of criminal detention is lighter and the balance of different months is inconsistent,criminal detention has a significant impact on the fine penalty,probation discretion activities are relatively more normative,alcohol content is the core element of sentencing.On the whole,there are few factors that have practical influence on sentencing activities,and there is little difference in sentencing results corresponding to different criminal acts.The reason is that the social harm of this crime is slight in the sense of result,the sentencing resources provided by criminal law norms are insufficient,and the evidence materials directly indicating the danger of driving behavior are scarce.The following measures can be taken to further standardize sentencing activities:first,to construct a basic sentencing framework with non-absolute alcohol content standards and different violations;the second is to build a sentencing system with substantial differences through“proviso”“non-prosecution”“exemption”“probation”and“actual punishment”;the third is to comprehensively standardize the evidence collection activities of administrative personnel through criminal procedure standards to ensure the fairness of sentencing activities.
