党内备案审查机关的合宪性审查职能

The Constitutional Review Function of the Party's Filing Review Organs

党内备案审查机关应当承担初步的合宪性审查职能,有权向全国人大常委会提出针对党内法规的合宪性审查处理建议。《党内法规备案审查规定》第11条有关合宪性审查的规定应当符合《宪法》中宪法解释权、宪法监督权以及保证宪法实施义务的规范意旨。全国人大常委会的合宪性审查权派生于宪法解释权,这是一种终局性的合宪性审查权。党内备案审查机关履行的是保证宪法实施义务,它可以宪法为依据对党内法规进行审查,但不能作出终局的合宪性审查结论。在审查标准上,合宪性审查对于党的领导和监督保障法规应当以比例原则为审查标准,而对党的组织和自身建设法规实施审查则以是否具有“超越宪法和法律的特权”为标准。

The party filing and review organs shall assume the preliminary constitutional review function and have the right to propose to the Standing Committee of the National People's Congress(NPC)to deal with the constitutional review of party regulations.The provisions of Article 11 of the Regulations on Filing and Reviewing Party Regulations concerning constitutionality review shall be consistent with the normative intent of the constitutional interpretation power,constitutional supervision power and the obligation to ensure the implementation of the Constitution in the Constitution.The NPC Standing Committee's power to review constitutionality is derived from the power to interpret the Constitution,which is a final power to review constitutionality.The party filing review organ fulfills the obligation to ensure the implementation of the Constitution,and it can review the party regulations on the basis of the Constitution,but cannot make a final constitutional review conclusion.In terms of review criteria,the review of constitutionality should be based on the principle of proportionality for the Party's leadership and supervision and protection regulations,while the review of the Party's organization and self-construction regulations should be based on whether they have“privileges beyond the Constitution and laws”.
