论我国行政法学理论体系的变革与重构——以主观公法权利理论引入为视角

Reform and Reconstruction on Theoretical System of Administrative Law in China——From the Perspective of Subjective Public Law Rights Theory

当前以行政行为理论为核心的行政法学理论体系逐渐暴露出不足,需要进行变革重构加以完善,主观公法权利理论的引入或许可为行政法学理论体系的变革重构提供新思路、新方向。具体可以考虑以法律关系理论为基础,构建“客观行政行为理论”和“主观公法权利理论”统一的“双核”行政法学理论体系。我国学界对行政行为理论研究已较为成熟,构建“双核”行政法学理论体系的重点在于引入主观公法权利理论,强化主观公法权利理论的地位和作用,促进客观行为理论与主观权利理论二者相互融合,最终形成主客观统一的“双核”行政法学理论体系,为我国制定行政法典夯实理论基础。

At present,the theoretical system of administrative law,with a core theory of administrative action,has gradually exposed its deficiency,which needs to be improved by reform and reconstruction.The introduction of the theory of subjective public law rights may provide new ideas and new directions for the reform and reconstruction of the theoretical system of administrative law.Specifically,based on the theory of legal relations,we can construct a unified“dual-core”theoretical system of administrative law,which unified the theory of objective administrative act and the theory of subjective public law rights.The theoretical research on administrative behavior in the academic circles of our country has been relatively mature.The focal point of constructing the theoretical system of“dual-core”administrative law is to introduce the theory of subjective public law rights,strengthen the status and function of the subjective public law rights theory,and promote the integration of objective administrative act theory and public law rights theory.Finally,a unified“dual-core”theoretical system of administrative law is formed,which lays a solid theoretical foundation for the formulation of administrative code in our country.
