摘要
自2010年开始的“中华学术外译项目”的立项,大多数是具有“中国特色”的学术研究成果。这反映了中国哲学社会科学的发展,已有由学术话语“销售地”向“生产地”转变的倾向。这种转向之旨意在于提升中国特色学术话语的国际影响力,增强其学术话语权。刑法作为中国法重要的组成部分,也应具有这种意识。但是,其前提是中国刑法话语体系应具有“中国特色”的学术话语。中国刑法话语体系要直面缺乏“中国特色”话语的现实,就应寻找提炼中国特色学术话语的“理”和“路”。从宏观维度看,中国刑法学术话语主体应以唯物论思想为理据。具体到微观层面的实践,则应以“中国场域”为出发点和基础。因此,提炼中国特色刑法话语的路径应重视中国的时空、中国的实践、中国视角的国际化视野和对中国刑法未来图景的描摹。
Projects funded by the“Chinese Academic Translation Project”which began in 2010,are mostly the academic research achievements with“Chinese characteristics”.This reflects the trend from the“place of sale”to the“place of production”of academic discourse in chinese philosophy and social sciences.The purpose of this shift is to enhance the international influence of academic discourse with chinese characteristics and enhance its academic discourse power.As an important part of chinese law,criminal law should also have this awareness.However,the premise is that the discourse system of chinese criminal law should have the academic discourse of“Chinese characteristics”.In order to face the reality of the lack of“Chinese characteristics”discourse,China’s criminal law discourse system should seek the“reason”and“way”to refine the academic discourse with Chinese characteristics.From the macro perspective,the academic discourse subject of chinese criminal law should be based on materialism.The practice at the micro level should be based on the“China Field”.Therefore,the path of refining the discourse of criminal law with Chinese characteristics should attach importance to China’s time and space,China’s practice,the international vision of China’s perspective and the description of the future prospect of China’s criminal law.
