由静态到动态:人脸识别信息保护中的“同意”重构

From Static to Dynamic:Reconstruction of“Consent”in Face Recognition Information Protection

人脸识别信息属于敏感个人信息,具有内容丰富性、高度敏感性、难以保护性及强社交属性等特征。对人脸识别信息的收集、分析和使用一旦超越原初个人同意的场景,可能会对信息主体的人格、财产甚至人身安全造成损害,应当对人脸识别信息施以更加具有针对性的保护措施。我国当前对于人脸识别信息的保护仍停留在静态的知情同意阶段,虽然创新性规定了单独同意和同意撤回规则,却难以有效协调人脸识别信息保护与利用之间的利益冲突,无法从根本上解决同意困境。有必要在人脸识别信息保护同意规则构建中引入场景理论,对人脸识别信息收集利用适用动态同意制度,动态配置择入择出机制并保证信息主体知情权,形成兼顾人脸信息保护、流动与利用的动态同意模式。

Face recognition information belongs to sensitive personal information,which has rich content,high sensitivity,difficult protection and strong social attributes.Once the collection,analysis and use of face recognition information go beyond the original scene of personal consent,it may damage the personality,property and even personal safety of the information subject.It is necessary to take more targeted protection measures.At present,the protection of face recognition information in China still stays in the static informed consent principle.Although the independent consent and consent withdrawal rules are innovatively stipulated,it is difficult to effectively coordinate the conflict of interest between the protection and utilization of face recognition information,and can not fundamentally solve the consent dilemma.It is necessary to introduce the scene theory into the construction of face recognition information protection consent rules,apply the dynamic consent system to the collection of face recognition information,dynamically configure the in and out mechanism,and ensure the right to know of the information subject.Form a dynamic consent mode that takes into account the protection,flow and utilization of face information.
