法理时代环境法学范畴体系初探

A PreliminaryStudy on the Category System of Environmental Law

环境法学范畴体系应是由基石范畴、核心范畴及基本范畴和一般范畴构成的理论体系。环境正义更适合作为环境法学的基石范畴,是整个环境法学的基石、定盘星。环境权利、环境义务、环境利益以及环境法法权都不适宜作为或单独作为环境法学的核心范畴,只有环境权利和环境义务共同作为环境法学核心范畴构成环境法学的骨干,两者缺一不可。由此,环境法学范畴体系应是由以环境正义为基石范畴、以环境权利和环境义务为核心范畴,以大量基本范畴和一般范畴为"肌肉"构成的逻辑严密、层次分明的统一理论体系。

The category system of environmental jurisprudence should be a theoretical system composed of basic category,core category,basic category and general category.Environmental justice is more suitable as the cornerstone category of environmental law,and is the cornerstone and anchor of the whole environmental law.Environmental right,environmental obligations,environmental benefit and environmental law of law are not appropriate for or separately as a core category of environmental law,only the environmental rights and obligations as a common core categories that form the backbone of the environmental law,environmental law both.So,category of environmental law system should be composed of environmental justice as the cornerstone category,category of environmental rights and obligations as the core,with a large number of basic categories and the general category for"muscle"which constitute a logical,distinct unified theory system together.
